The Government of Ontario passed the Green Energy Act, 2009 on May 14, 2009. The Act includes a section that would require sellers to provide home energy ratings to buyers unless the buyer waives the requirement in writing.
Despite having passed the Green Energy Act, the government has not passed the required regulations which would implement a provincial system of Mandatory Home Energy Audits (MHEA).
Without these regulations, the Mandatory Home Energy Audit section of the Green Energy Act has no effect and establishes no requirements on present real estate transactions.
From discussions with Ministry of Energy staff, the Ontario Real Estate Association has learned that the government has no time line in place to begin consulting with stakeholders on draft regulations. Minstry staff are waiting for approval from the Minister’s office before they can proceed.
